HC directs DC Kupwara to file status report on illegal encroachment of migrant Pandit’s land | KNO

Srinagar, July 09 (KNO): The Jammu and Kashmir High Court has directed deputy commissioner Kupwara to file status report on the complaint of petitioner regarding illegal encroachment on migrant land in Gund Gushi village of north Kashmir’s Kupwara district. In a notice, available with the news agency—Kashmir News Observer (KNO) the High Court has directed the deputy commissioner Kupwara to file a status report and ordered that the nature of the property shall not be changed in any manner. The petitioner namely Reeta Pandita, a Kashmiri migrant through her attorney had approached the court with the plea that she has ancestral land at Gund Gushi but the same is being illegally encroached upon by some persons (private respondents). “Despite filing complaint before DC Kupwara who is statutory authority under the Jammu and Kashmir migrant immovable property (preservation, protection & restraint on distress sales) Act, 1997, but he has not taken any step for the redressal of the grievance.” The Bench comprising Justice Rajnesh Oswal after hearing counsel of the petitioner advocate Sajad Geelani and advocate Mansoor Ahmad Mir, issued notice to the respondents through email and to private respondents through SHO police Station Kupwara. The court also directed DC Kupwara to file a status report regarding the complaint lodged by the petitioner against illegal encroachment. The bench further directed that status quo with regard to subject matter of writ petition shall be maintained and the nature of the property in question shall not be changed in any manner. The matter has been fixed for further hearing on 5th August 2020—(KNO)
